FOR IMMEDIATE RELEASE — Fort Washington, PA — June 3, 2005 — McNeil Consumer & Specialty Pharmaceuticals is voluntarily recalling all lots and all flavors of Children’s TYLENOL® Meltaways 80 mg packaged in bottles and blisters, Children’s TYLENOL®SoftChews 80mg packaged in blisters, and Junior TYLENOL® Meltaways 160mg packaged in blisters. The blister package design, as well as the information on the blister package and on the blister and bottle cartons may be confusing and could lead to improper dosing, including over-dosing.

Child safety seats are easier to use according to an annual National Highway Traffic Safety Administration (NHTSA) survey released today. NHTSA rated 92 child safety seats from 14 different manufacturers for 2005.

People with diabetes may be at higher risk for cardiovascular problems when air pollution levels are higher, according to a new study of Boston-area residents. The ability of the blood vessels to control blood flow was impaired in adults with diabetes on days with elevated levels of particles from traffic and coal-burning power plants.

Settlement Provides Up To $20 Million In Consumer Redress
Two Florida businesses have agreed to a federal court order requiring them to pay up to $20 million in consumer redress – the largest monetary judgment ever obtained in an FTC health fraud case – to settle charges that they deceptively claimed that their pills and sprays would increase consumers’ human growth hormone (HGH) levels and provide anti-aging benefits, including weight loss and increased cognitive function. In addition, the Commission has issued warning letters to more than 90 Internet marketers making similar claims.

The federal bank, thrift, and credit union regulatory agencies today issued interim final rules under the Fair Credit Reporting Act (FCRA) that create exceptions to the statutory prohibition against obtaining or using medical information in connection with credit eligibility determinations. The interim final rules also address the sharing of medically related information among affiliates.

FTC Puts the Squeeze on Tropicana’s Orange Juice Claims
Tropicana Settles FTC Charges It Lacked Evidence to Support Heart and Stroke-Related Claims Made for Its “Healthy Heart” Juice
The Federal Trade Commission has settled a complaint against Tropicana Products, Inc., in which it alleged the company misled consumers with claims that drinking two to three glasses a day of its “Healthy Heart” orange juice would produce dramatic effects on blood pressure, cholesterol, and homocysteine levels, thereby reducing the risk of heart disease and stroke. Under the terms of the consent agreement settling the charges, Tropicana is prohibited from making similar health-related claims in the future unless they can be substantiated by reliable scientific evidence.

Court Order Bars Deceptive Investment Pitches
Commission Charged Defendants with Violations of FTC Act and Telemarketing Rule
The Federal Trade Commission has settled a complaint against a set of California-based defendants whose telemarketers and promotional brochures allegedly misled hundreds of consumers about their ability to make big money by speculating on foreign currency prices. The Commission also charged the defendants with making a variety of other misrepresentations, including how and when investors could access their money, and that the defendants would not make money unless the investors did. The stipulated court order settling the FTC’s complaint bars the defendant from making any of the false claims put forward in their telemarketing and written promotional pitches.

FDA Warns Against Abuse of Dextromethorphan (DXM)
The Food and Drug Administration (FDA) is concerned about the abuse of dextromethorphan (DXM), a synthetically produced ingredient found in many over-the-counter (OTC) cough and cold remedies. The agency is working with other health and law enforcement authorities to address this serious issue and warn the public of potential harm, after five recently reported deaths of teenagers that may be associated with the consumption of powdered DXM sold in capsules.
